Welcome to 3shots (the "Service"). These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you," "user," or "seller"), and FantasyPilot LLC ("we," "us," or "our"), concerning your access to and use of our web application, marketing site, and the official 3shots Browser Helper Chrome extension (collectively, the "Product").

By registering an account, installing the Browser Helper, or accessing the Service, you acknowledge that you have read, understood, and agree to be bound by all of these Terms and our Acceptable Use Policy. If you do not agree, you are strictly prohibited from using the Service and must cease use immediately.

1. User Eligibility & Geographic Restrictions

A. Age Requirements

To register an account or use the Service, you must be at least 18 years of age. We do not target, collect data from, or market the Product to individuals under the age of 18 (COPPA compliance).

B. Territory

The Service is intended primarily for residents of the United States. By using the Service, you represent that your use complies with the laws of your jurisdiction. You are responsible for ensuring that your listings and sales comply with all applicable federal, state, and local laws.

2. What 3shots Is (and Is Not)

3shots is an AI-assisted listing helper. It helps you photograph items, generate listing kits, host a buyer-facing track page, and optionally use a browser helper to post or reply on Facebook Marketplace, Nextdoor, and OfferUp.

  • Not a Marketplace of Record: FantasyPilot LLC does not take title to your goods, host the classifieds marketplace, escrow funds, guarantee buyers or sellers, or mediate disputes between you and a buyer.
  • Not a Party to the Sale: Every sale is between you and the buyer. Payment handles you store (Venmo, Zelle) are peer-to-peer. We do not process card payments for item sales and do not hold buyer funds.
  • Third-Party Platform Terms: You must independently comply with the terms, community standards, and prohibited-items rules of Facebook, Nextdoor, OfferUp, and any other platform you use. Those platforms are not affiliated with FantasyPilot LLC.

3. Account Registration & Browser Helper

  • Account Security: You are responsible for activity under your Clerk-authenticated 3shots account and for safeguarding devices where the Browser Helper stores marketplace session tokens.
  • Marketplace Credentials: Marketplace session tokens remain in your browser. You represent that you are authorized to use those marketplace accounts.
  • Authorized Listings Only: You represent that you own or are lawfully authorized to sell each item you list, and that your photos and copy do not infringe others’ rights.

4. Billing and Fees

  • Cleanout plan: Stripe bills $9.99 per month for Cleanout. Checkout is hosted by Stripe. A successful charge is recorded on your account by webhook. The return page after Checkout is not itself proof of payment.
  • Cancel: Cancel from Settings. The plan stops at the end of the period you already paid. Access lasts through that date. There is no refund.
  • No refunds: We do not refund Cleanout charges. We do not take a cut of a sale between you and a buyer.

5. AI-Assisted Listings & No Fiduciary Duty

3shots uses Amazon Bedrock and related automation to propose titles, descriptions, condition labels, attributes, and related listing fields from your photos.

  • Informational Only: AI outputs are assistive suggestions. They are not appraisals, authenticity opinions, safety certifications, or professional advice.
  • You Must Review: You must review and correct any AI-generated content before posting it to a marketplace or sharing it with buyers.
  • No Fiduciary Duty: FantasyPilot LLC does not act as your broker, agent, attorney, or fiduciary for any sale.
  • Liability for Reliance: You assume the risk of decisions made in reliance on AI suggestions, including mispriced items, misidentified condition, or inaccurate descriptions.

6. Browser Helper Actions Bind the Seller

The Browser Helper may submit posts, updates, or replies to marketplaces using session tokens stored on your device when you initiate those actions through 3shots.

  • Principal Responsibility: Every marketplace action the helper performs with your local session is an act of you as the seller, as if you had performed it manually in the marketplace UI.
  • Full User Liability: You remain fully responsible for listing content, timing, buyer communications, cancellations, and compliance with each marketplace’s rules.
  • No Platform Affiliation: Use of the helper does not create any partnership, endorsement, or agency relationship with Facebook, Nextdoor, or OfferUp.

7. Intellectual Property & Ownership of Content

  • Platform IP: 3shots branding, product design, software, and documentation are the exclusive property of FantasyPilot LLC.
  • Your Content: You retain ownership of photos and text you upload. You grant FantasyPilot LLC a limited, worldwide, non-exclusive license to host, process, display, and transmit that content solely to operate the Product (including AI identification and buyer-facing kit pages).
  • AI-Assisted Listing Copy: We claim no copyright over purely model-generated listing text produced for your item. Hybrid content (your photos and edits combined with model output) is licensed to you for your personal, non-commercial use in selling that item, subject to these Terms.

8. Termination

We may suspend or terminate your access immediately for violation of these Terms, the Acceptable Use Policy, suspected fraud, or risk to other users or our infrastructure. You may stop using the Service at any time and may request account deletion as described in the Privacy Policy.

9. Governing Law, Binding Arbitration & Class-Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

  • Governing Law: These Terms and your relationship with us shall be governed by, and construed in accordance with, the laws of the State of Florida, without regard to its conflict of law principles.
  • Mandatory Binding Arbitration: Any dispute, controversy, or claim arising out of or relating to these Terms, the Service, or the Product shall be settled exclusively by individual, binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. The place of arbitration shall be Florida, and the arbitration shall be conducted in the English language.
  • Class-Action Waiver: You and FantasyPilot LLC agree that any arbitration or legal proceeding shall be limited to the dispute between us individually. YOU WAIVE THE RIGHT TO PARTICIPATE IN A CLASS-ACTION LAWSUIT, CLASS-WIDE ARBITRATION, OR REPRESENTATIVE LEGAL PROCEEDINGS.

10. Limitations of Liability & Indemnification

To the maximum extent permitted by applicable law, in no event shall FantasyPilot LLC, its directors, employees, or partners be liable for any indirect, incidental, special, consequential, or punitive damages (including, without limitation, lost sale proceeds, buyer disputes, marketplace account bans, data loss, or goodwill) arising out of your use of the Service. Our total cumulative liability to you for any claims shall not exceed the greater of (a) the amount you paid to us for the Service during the prior twelve (12) month period, or (b) one hundred U.S. dollars (US $100) if you have paid nothing.

You agree to defend, indemnify, and hold harmless FantasyPilot LLC from and against any claims, damages, obligations, losses, liabilities, costs, or debt (including attorney’s fees) arising from your use of the Service, your listings or sales, your violation of these Terms or any marketplace’s terms, or any dispute with a buyer or third party.

11. SMS / text messages

Texts are only about your listings and buyers. Message and data rates may apply. Frequency varies. Reply STOP to opt out and HELP for help. We never share or sell your number. You opt in from Settings › Your agent by entering a mobile number and ticking the consent line.
